Public Offer Agreement

This Agreement is a public offer (offer to the public) of the TWO A online store for the sale of goods presented on the website.

1. GENERAL PROVISIONS

1.1. This public offer agreement (hereinafter — the Agreement) is the Seller’s offer to enter into a contract of sale of Goods by distance selling.

1.2. The Agreement is deemed concluded when the Buyer places an order on the website and the Seller confirms it.

1.3. Placing an order means full and unconditional acceptance by the Buyer of the terms of this Agreement (acceptance).

1.4. The Seller and the Buyer warrant that they have legal capacity and all rights and powers to enter into and perform this Agreement.

2. DEFINITIONS

Seller — a sole proprietor or legal entity selling goods through the TWO A online store.

Buyer — an individual or legal entity who has placed an order in the online store.

Goods — the subject of sale presented on the online store website.

Order — a duly completed request by the Buyer to purchase Goods.

3. SUBJECT OF THE AGREEMENT

3.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods in accordance with this Agreement.

3.2. The name, quantity, assortment, and price of the Goods are determined based on the information on the website and in the order confirmation.

4. ORDERING PROCEDURE

4.1. The Buyer places an order independently on the website via the cart or with the assistance of a manager by phone or email.

4.2. When placing an order, the Buyer must provide accurate information:

  • Full name (surname, first name, patronymic)
  • Contact phone number
  • Delivery address or branch number
  • Email address

4.3. The Seller reserves the right to refuse to process an order if the Buyer provides inaccurate information or for objective reasons.

5. PRICE AND PAYMENT

5.1. Prices for Goods are indicated on the website in the national currency of Ukraine — hryvnia (UAH).

5.2. The Seller may change prices without prior notice. The price of an ordered Goods item shall not change.

5.3. Payment may be made by one of the following methods:

  • Online payment by bank card (Visa/Mastercard, Apple Pay, Google Pay)
  • Cash on delivery upon receipt
  • Bank transfer to the settlement account

6. DELIVERY

6.1. Delivery is carried out by Nova Poshta to the address or branch specified by the Buyer.

6.2. Delivery time: 1–3 business days from dispatch.

6.3. Delivery cost is calculated separately and depends on the order parameters.

6.4. The risk of accidental loss or damage to the Goods passes to the Buyer upon handover of the Goods.

7. RETURNS AND EXCHANGES

7.1. The Buyer may return Goods of proper quality within 14 days of receipt in accordance with the Law of Ukraine “On Consumer Protection”.

7.2. Return conditions:

  • The Goods have not been used
  • Commercial appearance and consumer properties are preserved
  • All labels and tags are intact
  • Proof of purchase is available

8. RIGHTS AND OBLIGATIONS OF THE PARTIES

The Seller undertakes to:

  • Transfer Goods of proper quality to the Buyer
  • Deliver the Goods within the agreed time
  • Provide accurate information about the Goods

The Buyer undertakes to:

  • Provide accurate contact details
  • Pay for and receive the Goods in a timely manner
  • Read the terms of this Agreement

9. LIABILITY

9.1. The parties are liable for non-performance or improper performance of this Agreement in accordance with applicable law of Ukraine.

9.2. The Seller is not liable for delivery delays caused by third parties (carrier, force majeure).

10. CONFIDENTIALITY

10.1. The Buyer’s personal data is processed in accordance with the Privacy Policy and the Law of Ukraine “On Personal Data Protection”.

10.2. The Seller guarantees non-disclosure of the Buyer’s personal data to third parties except as required by law.

11. OTHER TERMS

11.1. This Agreement enters into force upon placing an order and remains in effect until the parties fully perform their obligations.

11.2. The Seller may amend this Agreement unilaterally. Amendments take effect upon publication on the website.

11.3. Disputes shall be resolved through negotiation; if no agreement is reached — in accordance with applicable law of Ukraine.
